Please scrutinise all the proposed amendments and replies before commenting or voting. Short comments are most often read and must not exceed 100 words. You can propose an Amendment at the bottom of this page - please read the guidelines .
Note that the original wording appears again first below and sustains the same comment & voting regime as all other amendment proposals.
Section 2.4. Section 2.4. Freedom of expression through the media and electronic communication and public demonstrations is guaranteed, subject to the law.
Section 2.4. By specifying "through the media and electronic communication and public demonstrations", this appears to be more restrictive than Article 10 of the ECHR.
Section 2.4. This should be combined, if it is needed at all, with Section 2.8.
Section 2.4. Section 2.4. Freedom of expression through the media and electronic communication and public demonstrations is guaranteed, subject to the law and consistent with section 2.2. and does not involve slander, libel or misrepresentation.
Section 2.4. I would have thought that "subject to the law" covers "..and does not involve slander, libel or misrepresentation."
Section 2.4. Slander and libel are terms of English law. The Scots law term to cover bothe is defamation.
Section 2.4. Correct!
Responsibilities of the media.
Section 2.4. All members of the media, notwithstanding the constitutional rights mentioned above, will be held libel either individually, or grouped to form a collective, for disseminating or printing non factual or inaccurate statements in any form. This is not intended to prevent discourse, but rather to ensure responsibility of the free press and its agents.
Proposed combination of 2.4 and 2.8, in light of ECHR
Section 2.4. Freedom of expression, by whatever means, is guaranteed for all, subject to such cconditions as may be prescribed by law within the limits laid down by Article 10 of the European Convention on Human Rights.
Section 2.4. Freedom of expression as detailed above is too prescriptive. Other avenues are feasible, writing to your MP, petitions etc etc....
Section 2.4. Pauline this is a comment, not a Proposal - see below and Guidelines please - it is not possible to vote on partial proposals. This will require to be removed - please replace.
