The Scottish State prohibits the presence, transportation or development of nuclear, biological or chemical weapons, parts or components thereof, throughout its land, territorial waters or airspace, such actions being deemed a criminal offence. Any such material currently existing within Scotland must be removed within three years of the date of ratification of this Constitution.

Section 15.11. Whilst generally supporting this prohibition, I am conscious that England will require time to find safe alternatives to Faslane. Forcing a time scale that is too fast could result in an unsafe alternative, possibly close to Scotland. Barrow? We should press for a safe transition with large rents payable on any Scottish locations used in the interim.

Prohibition on nuclear, biological or chemical weapons. The Scottish State prohibits the presence of such weapons and appurtenances within its borders such breach being deemed a criminal offence. Failing agreement within one year of the ratification of this clause to remove all such materials within a further two years will require any alternative proposal to be put to a National referendum.
Section 15.11. One can imagine the pressures from the UK, US & NATO on a Scottish Government to compromise over this clause. It may need the endorsement of a referendum to resist blackmail and help it stick to its principles.
Section 15.11. Agreed. This will be a major issue and perhaps millstone in negotiations with rUK. The time limit should be within the lifetime of the first parliament. It needs to be reasonable and allow sufficient time for storage facilities for NBC items to be constructed.

Committed, as I personally am, to the abolition of nuclear, biological. viral , deathray or other unforeseen Weapons of Mass Destruction, we must be careful. There is a significant tranche of opinion which believes these things are Necessary and this issue is Not Germane to the Independence objective, which is paramount. Once Independent, Scotland can, in time, adopt a Constitutional Amendment on this subject.
Section 15.11. The time limit may be unreasonably difficult for rUK to comply. The principle of the amendment is well intentioned but may be difficult for rUK to achieve.
Section 15.11. In retrospect this clause may be key to all negotiations as it involves not only RUK but also the US and NATO. That makes it our prime negotiating strength not only on this issue but perhaps on others too. So perhaps we should leave our negotiators some flexibility. Certainly not a sovereign base at Faslane & Coulport but potentially a lease for a reasonable period to make alternative arrangements. Otherwise it might be the rock on which the independence project founders…
