Section 9.2. The supreme criminal court in Scotland is the High Court of Justiciary, not of Judiciary. This kind of drafting shows a lack of knowledge of Scots law and a lack of attention to detail which mean that the whole draft constitution will have to be thoroughly revised by competent Scottish legal drafters before any fine-tuning can take place.

Elsewhere on the site you would have seen that our policy is to set out a non-prescriptive Model Constitution in lay terms to encourage maximum participation. It is also accepted that in due course it will form one part of a more formal Constitutional Convention where other proposals will be considered prior to a final version being compiled in appropriate legal terms.
