Section 9.2. The supreme criminal court in Scotland is the High Court of Justiciary, not of Judiciary. This kind of drafting shows a lack of knowledge of Scots law and a lack of attention to detail which mean that the whole draft constitution will have to be thoroughly revised by competent Scottish legal drafters before any fine-tuning can take place.

Section 9.2. Hail Caledonian – you are contributing significantly and eruditely to our Conversation – thank you. Elsewhere on the site you would have seen that our policy is to set out a non-prescriptive Model Constitution in lay terms to encourage maximum participation. It is also accepted that in due course it will form one part of a more formal Constitutional Convention where other proposals will be considered prior to a final version being compiled in appropriate legal terms.
The site will be open for several years before then and we hope you will continue to contribute and monitor its development. But please include a Headline in your Proposed Amendments…
